Pregnant dog about to deliver, but beaten to death by a lady today! We received a call for procedural guidance. We advised the following process as per our long experience and the complainant got success. The wicked lady has been picked up by the Police.
Issued in public interest, these are answers to Legal FAQ about how to get justice for a murdered animal using 10 points of the following method:
1) Before you start from home, write on an A4 paper, “We have all witnessed……so and so incident involving so and so accused/ suspected person or persons…. that caused the intentionally inflicted injuries to the animal that lead to its death at so and so location on so and so date and time.” The lower half of the sheet should be filled with serial numbered names, mobile numbers and signatures of the witnesses. On the spot, get the witnesses to sign it while the matter is still HOT.
2) Cordon off the body to prevent disposal. Engage and involve volunteers to prevent disposal. Call Police by phone and request them to come and take cognizance of the crime and body at the Place of Incident (POI).
3) Whether the Police come or not is not your lookout. You must do everything that you should be doing. Police will have to answer to Court about why they didn’t do what they should have done. You’ve to reach that state through your own actions.
4) With our without Police visit to POI, the body must be preserved immediately for post mortem in thermocol box packed with ice and salt, packed in presence of few witnesses who should sign a separate witness statement.
5) Post Mortem is not done by any vet without police demand. And post mortem done outside of Govt hospital is not accepted by police.
6) Photographing the scene of crime showing identifiable background features and the act of ice boxing of body is to be done. Preferably use a mobile that can print timestamp on photo. Videos are useless for legal purposes. Don’t waste time on videos.
7) With or WITHOUT the signed statements, file a written complaint to police. Without a written complaint, nothing will move. Even without witness statement, the case will move if you write out your complaint properly. Consult RKD Pet Shop for drafting the complaint if you don’t know what and how to write.
8) Complaint letter must mention request for filing unnatural death case and post mortem along with demanding to file a criminal case for punishing the guilty.
9) Then the box must be taken to police along with written complaint requesting FIR and registering an Unnatural Death Case (U/D Case), with mention of preserved body offered to police for custody. That automatically casts responsibility on Police to get the post mortem done at Govt vet hospital.
10) Only then a murder case of an animal can stand in the Court.
